Chapter 13 Bankruptcy

 

               

Chapter 13 is often referred to as "reorganization." Filing under Chapter 13 allows individuals with an income to reorganize their debts and pay them by making monthly payments to the Trustee. You must have a source of income to file under Chapter 13.

You will be scheduled to attend your 341 Meeting of Creditors approximately one month after your case is filed. You must bring your photo ID and Social Security card to this meeting. The Trustee must review your income tax return at your meeting, so if you have not given a copy to us, please bring your tax return to the meeting. Your actual meeting will last only 10 minutes or so, but it may be 2-3 hours before your case is called. Which Division do you live in?

The Savannah Division includes Bryan, Chatham, Effingham and Liberty Counties.

The Statesboro Division includes Bulloch, Candler, Emanuel, Evans, Jenkins, Screven, Tattnall, and Toombs Counties.

Your first payment is due 30 days after your case is filed and every 30 days thereafter. Please bring a money order to your 341 Meeting of Creditors, and we will mail your first payment for you.


If you are employed and your payment is deducted from your paycheck soon after your case is filed(2-4 weeks), then you will need to purchase only one money order for your first payment as your other payments will be sent to the Trustee by your employer. Please keep your money order receipt and your pay stubs. If your employer does not withhold the correct amount each month, you need to send the Trustee a money order for the difference so that the Trustee receives a full payment each month.


If your payment is not withheld by your employer, then you must mail a money order to the Trustee each month. It is very important that you keep all receipts.
